YOUR RESPONSIBILITIES WHEN HIRING RANKIN

The customer acknowledges and agrees to strictly comply with the following rules:

1. The Customer is always solely and fully responsible for the safety of all passengers and the care of an Hired Equipment.

2. Only the Customer or other boat operator approved by the Company in writing are permitted to use or operate the Hired Equipment.

3. Anyone operating the Hired Equipment must have all licenses required by law including, without limit, a current recreational skipper's ticket.

4. The Hired Equipment must not be left under the care or control of anyone who does not possess a current recreational skipper's ticket.

5. Without limiting Rule 6, the Customer will not exceed a speed of 13 knots (25kph)at any time while using or operating any Hired Equipment or allow anyone else to do so.

6. All speed limits and applicable laws must be strictly observed by anyone operating the Hired Equipment.

7. No person under the age of 21 is permitted to operate the Hired Equipment.

8. The Hired Equipment must only be operated within an area of 10.8 nautical miles (20kms) from shore and 32 nautical miles (60kms) laterally of Port Hedland, unless otherwise agreed to in writing by the NCO Boat Hire.

9. The Hired Equipment must not be used or operated where damaged or unsafe to do so, or where the Hired Equipment has been involved in an accident during the Term of this Hire Agreement .

10. The Hired Equipment must not be used to carry and dangerous or flammable items.

11. Smoking and the consumption of alcohol and drugs are not permitted at any time while the Hired Equipment is in use.

12. The Hired Equipment must not be used or operated in adverse weather conditions including, without limit, where the forecast wave height exceeds two (2) metres, or where the forecast or actual wind speed exceeds 20 knots per hour.

13. The Hired Equipment must not be used for any of the following activities under any circumstances:

(a) Water skiing or any other activity involving persons being towed, pulled or made airborne behind any Hired Equipment.

(b) Scuba diving.

14. The Hired Equipment must only be operated during daylight hours.

15. The Hired Equipment must not be used to carry passengers or property for hire.

16. The Hired Equipment must not be used to carry passengers or property more than the rated capacity of the Hired Equipment.

17. The Hired Equipment must not be used to tow or propel any other boat, barge or thing.

18. The Hired Equipment must not be used in any race or competition.

19. The Hired Equipment must not be used for any illegal purpose.

20. The Hired Equipment must not be used in a negligent manner.

21. The motor must not be removed from the Hired Equipment whatsoever.

22. The hirer must have a minimum of two (2) years' experience.

23. Maximum 5 passenger on board

24. NCO Boat Hire reserves the right to cancel the hire at any time if there are any safety concerns.

25. The hired equipment must not be left unattended at any time during the hire.

26. The hired equipment must not be operated in less than 1.5meters of water.
